PESHAWAR: The Peshawar High Court (PHC) on Monday granted transit bail to Noreen Niazi, the sister of incarcerated PTI founder Imran Khan, in a case registered under the Peca Act 2026, directing her to appear before the relevant Islamabad court on or before August 20.
In July, the National Cyber Crime Investigation Agency (NCCIA) registered a case against Noreen, accusing her of passing derogatory and inflammatory remarks against state institutions during a podcast interview and in subsequent clips shared on X.
A single-member PHC bench comprising Justice Arshad Ali heard Noreen’s petition, represented by a panel of lawyers, including Ali Zaman, Amir Zeb and Barrister Sarwar Muzaffar Shah
In its order issued on Monday, the bench stated that the petitioner had approached the court seeking transit bail in connection with a first information report (FIR) registered against her at the NCCIA police station in Islamabad on July 27 under various provisions of the Peca Act 2016 and the Pakistan Penal Code, enabling her to approach the competent court.
The order noted that the petitioner had claimed to have been falsely implicated in the case and that, except for the bare allegations contained in the FIR, there was no other cogent evidence on record to connect her with the alleged offence.
“In the circumstances of the case, the petitioner’s request, being reasonable, merits consideration,” the order noted, adding that “consequently this application is accepted and the accused petitioner is granted ad-interim transit pre-arrest bail provided she furnishes bail bonds in the sum of Rs80,000 with two sureties,” it said.
The bench also directed the petitioner to approach the competent forum in Islamabad for bail on or before August 20, as the PHC order would be effective till that day.
Meanwhile, the counsels for the petitioner argued that their client was innocent and falsely implicated in the case registered at the NCCIA police station.
They said the local police were trying to arrest their client with mala fide intentions, to humiliate and unjustly harass her for some ulterior motive.
The counsels also said the allegations contained in the FIR were false and politically motivated, and were based on an erroneous interpretation of statements allegedly attributed to their client.
Talking to reporters after the hearing, Noreen said she came to know about the NCCIA case against her after arriving in Peshawar.
“I did speak inside in my house, which I do not have recollection of, and someone got that to them and they made a case against me,” she claimed.
Noreen further alleged that cases had been lodged against her other sisters and that now one had been registered against her as well. “Too many cases are being registered across Pakistan, and no one knows why they have been lodged. The case against me is the same,” she said.
In response to a question, she said they had never been to Peshawar, so the question of their interfering in KP affairs did not even arise.
Earlier, the Lahore High Court had also granted her an interim protective bail, directing her to approach a relevant Islamabad court.
Before registering an FIR, the NCCIA had summoned Noreen to appear before it on July 20 over allegations of disseminating “false, offensive and inflammatory” content against state institutions.
While the notice did not specify the content in relation to which Noreen has been summoned, it was issued after the clip of her making claims in relation to last year’s brief military conflict between Pakistan and India was widely shared on social media.
In the clip, she is seen alleging during an interview that the conflict was “orchestrated” to improve the image of Pakistan’s military. She claimed the “drama” was played out in collaboration with Indian Prime Minister Narendra Modi, questioning why Modi would have refrained from further attacking Pakistan otherwise.
In this connection, she went on to allege that the objective was to get Israel recognised by Pakistan, linking US President Donald Trump’s praise of Pakistan’s leadership with Israel’s recognition as well.
